Managed Website Hosting Terms & Acceptable Use Policy

These Managed Website Hosting Terms & Acceptable Use Policy (“Hosting Terms”) apply to all website hosting services provided by A to Z Website Solutions (“we”, “us”, “our”) to the customer (“you”, “your”).

By purchasing, using or continuing to use our Managed Website Hosting Service, you agree to these Hosting Terms.

These terms are designed to protect you, other customers, our hosting infrastructure and the reliability and security of the services we provide.

1. Our Managed Hosting Service

Our Managed Website Hosting Service provides hosting and associated management and support for your website.

Depending on your selected package, the service may include:

  • Website hosting
  • Web space and bandwidth
  • SSL certificate
  • Website security protection
  • Daily backups
  • Website monitoring
  • cPanel access
  • FTP access
  • Email hosting and management
  • Website migration and configuration
  • Technical hosting support

The exact features, allowances and price applicable to your service are those shown on your selected hosting package or order at the time of purchase.

2. Managed Hosting

Our service is provided as managed website hosting.

This means we may manage, configure, monitor, maintain and protect the hosting environment on your behalf.

Where necessary to maintain security, stability or performance, we may make reasonable technical changes to the hosting environment without requiring prior approval.

3. Your Responsibilities

You are responsible for the website, files, applications, email accounts, databases and other content stored or operated through your hosting account.

You must ensure that your use of the service complies with these Hosting Terms and all applicable laws and regulations.

You are also responsible for keeping passwords and login information secure and informing us promptly if you believe an account has been compromised.

4. Acceptable Use

Our hosting services must be used for legitimate website and business purposes.

You must not use our hosting services for illegal, abusive, harmful or disruptive activities.

Prohibited activities include, but are not limited to:

  • Sending spam or unsolicited bulk commercial email
  • Hosting or distributing pirated software or copyright-infringing material
  • Hosting illegal content
  • Hacking or attempting unauthorised access to systems or networks
  • Password cracking
  • Denial-of-service or distributed denial-of-service attacks
  • Network sniffing or spoofing
  • Distributing viruses, malware, Trojan horses or malicious code
  • Phishing or fraudulent websites
  • Using false identities for fraudulent or deceptive purposes
  • Operating BitTorrent or other peer-to-peer file-sharing services
  • Operating public file-sharing services
  • Using the hosting account primarily as online file storage, backup storage or an email archive
  • Running software or processes that unreasonably interfere with server performance
  • Attempting to bypass server security or resource restrictions
  • Using the service in any way that could damage our systems, network, reputation or the service provided to other customers.

We reserve the right to determine whether particular activity represents unacceptable use where it threatens the security, reliability, reputation or operation of our services.

5. Illegal and Seriously Harmful Content

You must not use the service to host, publish, store or distribute material that is unlawful.

This includes content involving child sexual abuse material, unlawful exploitation, fraud, malware, serious copyright infringement or other criminal activity.

Where we become aware of potentially illegal material or activity, we may suspend or terminate the affected service immediately.

Where required or appropriate, information may also be preserved or disclosed to relevant law enforcement or regulatory authorities in accordance with applicable law.

6. Server Resources and Fair Usage

Managed hosting operates within reasonable technical and resource limits.

You must not operate scripts, software, processes or websites that use excessive server resources or adversely affect the performance, security or availability of the hosting environment.

We may impose limits relating to CPU usage, memory, disk usage, file quantities, processes, database activity, email sending, automated tasks, bandwidth or other server resources.

Where a website consistently requires resources beyond those reasonably available under the selected hosting package, we may ask you to reduce the usage, upgrade to a more suitable service or move the website to another hosting environment.

In urgent situations where resource usage is affecting server stability, security or other customers, we may temporarily restrict or suspend the affected service before contacting you.

7. Storage

Hosting storage is provided primarily for files and data required to operate your website and associated services.

The service must not be used primarily for:

  • General online file storage
  • Personal cloud storage
  • Long-term backup storage
  • Large software archives
  • Public file distribution
  • Email archiving
  • Storing large quantities of files unrelated to the hosted website.

We may require files that do not relate to the operation of your website to be removed.

8. Backups

Daily backups are included with our Managed Hosting Service where stated in your package.

Backups are provided as a recovery and disaster-protection feature and should not be treated as the only copy of important business information.

Although we take reasonable steps to maintain reliable backups, no backup system can be guaranteed to be completely failure-proof.

You should therefore maintain independent copies of any business-critical files, databases, emails or other information that you cannot afford to lose.

Where technically possible, we will assist with restoring a website from an available backup following a hosting or website problem.

9. Email Usage

Where email hosting is included, email accounts must be used responsibly.

You must not use our servers to send spam, unsolicited bulk email, fraudulent messages, phishing messages or malicious content.

Email sending is subject to reasonable hourly and daily limits designed to protect server performance and email reputation.

Our standard website hosting service is not intended to operate as a bulk email marketing platform.

Businesses wishing to send newsletters, large mailing lists or marketing campaigns should use a dedicated email marketing service.

We may temporarily restrict outgoing email where unusual activity, compromised accounts, spam or excessive sending is detected.

10. Automated Processes and Scripts

Automated scripts, scheduled tasks and cron jobs must operate within reasonable resource limits.

You must not run:

  • Stand-alone server daemons or persistent background processes unless specifically authorised
  • Public web crawlers or intensive indexing software
  • Cryptocurrency mining software
  • Peer-to-peer applications
  • Software designed to attack, probe or scan external networks
  • Excessively frequent automated processes that affect server performance.

We may restrict or disable scripts or automated processes that create security, performance or stability problems.

11. Website Security

We take reasonable measures to protect websites hosted through our Managed Hosting Service.

However, no website, server or online service can be guaranteed to be completely secure.

You must not intentionally install software, plugins, themes, scripts or files that contain malicious code or create a known security risk.

If we identify a compromised website, malicious software or a serious security vulnerability, we may temporarily restrict access to the website while the problem is investigated and resolved.

This is intended to protect your website, visitors, our infrastructure and other customers.

12. Website Software

Where your website uses third-party software such as WordPress, plugins, themes, ecommerce systems or other applications, those products remain subject to their own licences and terms.

We are not responsible for defects, vulnerabilities, compatibility problems or changes introduced by third-party software developers.

Where website maintenance forms part of your service, we will take reasonable steps to maintain supported software and resolve issues within the scope of your package.

13. SSL Certificates

Where included in your hosting package, we will provide and manage an SSL certificate for your hosted website.

SSL certificates depend upon third-party certificate systems and correct domain configuration. We therefore cannot guarantee uninterrupted certificate availability where circumstances outside our reasonable control prevent renewal or validation.

14. Website Migration

Where migration is included, we will take reasonable care when transferring your website to our hosting environment.

We aim to minimise disruption and downtime during migration.

Some websites, applications, email configurations or third-party systems may require additional work or may not be fully compatible with our hosting environment. We will inform you where we identify a significant compatibility issue.

15. Availability and Uptime

We aim to provide a reliable and highly available hosting service.

Where an uptime commitment is advertised as part of your hosting package, this relates to the availability of the hosting infrastructure and does not mean that every individual website will be continuously available in all circumstances.

Website availability can be affected by circumstances outside our reasonable control, including:

  • Website software faults
  • Plugin or theme failures
  • DNS problems
  • Domain expiry
  • Cyber attacks
  • Third-party services
  • Internet network failures
  • Emergency maintenance
  • Security incidents
  • Customer actions
  • Events beyond our reasonable control.

We will take reasonable steps to restore affected services as quickly as practical.

16. Support

Managed Hosting includes reasonable support relating to the hosting environment and the operation of your hosted website as described in your package.

Hosting support does not automatically include unlimited website development, redesign, new functionality, content creation or work outside the scope of your hosting service.

If additional work is required, we will explain this before carrying out chargeable work.

17. Payments and Renewals

Hosting fees are payable according to the monthly or yearly payment option selected when you purchase the service.

Where recurring billing has been authorised, the service will continue and payments will be collected at the applicable renewal interval until cancelled.

You are responsible for ensuring that your payment information remains current.

We may change our hosting prices from time to time. Where a price change affects an existing recurring service, we will provide reasonable notice before the new price takes effect.

18. Failed or Overdue Payments

If payment cannot be collected or an invoice becomes overdue, we may contact you and provide an opportunity to bring the account up to date.

If payment remains outstanding, we reserve the right to suspend the hosting service.

Continued non-payment may result in termination of the hosting account and eventual deletion of hosted data.

You remain responsible for obtaining copies of important website files and data before a service is terminated.

19. Cancellation

You may cancel your Managed Hosting Service by contacting A to Z Website Solutions.

Cancellation prevents future renewal of the service but does not normally entitle you to a refund for a period of hosting that has already been supplied or paid for, unless otherwise agreed or required by law.

When your service ends, we will provide reasonable assistance to allow you to move your website elsewhere.

Where available, we can provide a backup of your website files and database.

You are responsible for arranging replacement hosting and completing any transfer within a reasonable period.

20. Data Following Cancellation

Hosting accounts and backups are not intended to provide permanent storage after cancellation.

Following termination or cancellation, website files, databases, emails, backups and other account information may eventually be permanently deleted.

You should therefore obtain all information you require before or promptly after cancellation.

We cannot guarantee that website data or backups will remain recoverable after the hosting service has ended.

21. Suspension

We may temporarily suspend or restrict a hosting service where reasonably necessary because of:

  • Non-payment
  • A security threat
  • Malware or a compromised website
  • Excessive server resource usage
  • Spam or email abuse
  • Illegal activity
  • A serious breach of these Hosting Terms
  • A threat to our infrastructure or other customers
  • A request from a competent legal or regulatory authority.

Where reasonable, we will contact you and provide an opportunity to resolve the problem.

Serious security, illegal activity or abuse issues may require immediate action without advance notice.

22. Termination

We reserve the right to terminate a hosting service where there is a serious or repeated breach of these Hosting Terms.

Serious abuse, illegal activity, deliberate security attacks, spam operations or activity that puts our infrastructure or other customers at significant risk may result in immediate termination.

No refund will normally be provided where a service is terminated because of a serious breach or prohibited activity, subject to your statutory rights.

23. Third-Party Infrastructure and Services

To provide our Managed Hosting Service, we may use third-party infrastructure, software, data centres, networks, security systems, control panels, backup systems and other technology suppliers.

You acknowledge that some elements of the service therefore depend upon third-party systems outside our direct control.

We may change infrastructure or technology suppliers where reasonably necessary to maintain or improve the service.

We remain your point of contact for your Managed Hosting Service.

24. Changes to the Hosting Environment

Technology, security requirements and hosting infrastructure change over time.

We may therefore modify server configurations, software versions, security requirements, resource limits or technical features where reasonably necessary to maintain security, performance, compatibility or reliability.

Where a change is likely to materially affect your service, we will make reasonable efforts to inform you.

25. Domain Names

Domain registration is separate from website hosting unless specifically stated otherwise in your order.

You remain responsible for ensuring that your domain name is renewed and that registration information is accurate where the domain is registered or controlled by you.

If we manage a domain on your behalf, additional domain registration terms may apply.

26. Customer Content and Intellectual Property

You retain responsibility for the content you provide or upload to your website.

You confirm that you have the necessary rights, permissions and licences to use that content.

You must not knowingly use our hosting service to publish or distribute material that infringes another person’s copyright, trademark or other intellectual property rights.

27. Data Protection

Each party must comply with applicable UK data protection law in relation to personal data processed through the service.

Depending on the nature of the website and services provided, additional privacy or data-processing terms may apply.

You remain responsible for ensuring that your website has appropriate privacy notices, cookie controls and other legal documentation required for your particular business and website.

28. Limitation of Liability

We will provide the Managed Hosting Service with reasonable care and skill.

However, internet and hosting services can occasionally be interrupted or affected by circumstances outside our reasonable control.

To the fullest extent permitted by law, we will not be responsible for indirect or consequential losses arising from downtime, loss of data, loss of business, loss of revenue, loss of opportunity or third-party services.

Nothing in these Hosting Terms excludes or limits liability where doing so would be unlawful, including liability that cannot legally be excluded under applicable UK law.

29. Events Outside Our Control

We will not be responsible for a failure or delay in providing the service caused by circumstances beyond our reasonable control.

These may include major network failures, data-centre incidents, cyber attacks, power failures, natural disasters, acts of government, industrial disputes, supplier failures or other events that we could not reasonably prevent.

30. Changes to These Terms

We may update these Hosting Terms where reasonably necessary because of changes to our service, infrastructure, security requirements, legal obligations or business practices.

The latest version will be published on our website.

Where a change materially affects an existing customer’s service or rights, we will take reasonable steps to provide notice.

31. Governing Law

These Hosting Terms are governed by the laws of England and Wales.

Any dispute will be subject to the jurisdiction of the courts of England and Wales, subject to any mandatory rights you may have under applicable consumer law.
